Welcome to Graphics by Khai (GK). These Terms of Service govern your access to and use of all services, digital products, and content provided by Graphics by Khai through its website, communications, and business operations.

By purchasing, booking, downloading, or otherwise engaging with any service or product provided by Graphics by Khai, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service. If you do not agree with these terms, you must not purchase or use any services offered by Graphics by Khai.

Graphics by Khai (GK) is a creative service provider specializing in digital design, branding, marketing materials, website design, motion graphics, and consulting services. The business operates internationally and serves clients across multiple countries. However, Graphics by Khai is owned, managed, and legally based in Jamaica, and all operations are governed and protected under the laws of Jamaica.

Acceptance of Terms
By purchasing any service or digital product from Graphics by Khai, the client confirms that they are legally able to enter into a binding agreement and that they fully accept these Terms of Service and any related policies. Graphics by Khai reserves the right to modify, update, or revise these terms at any time without prior notice. Continued use of services following any update constitutes acceptance of the revised terms.

Services Provided
Graphics by Khai provides a range of professional creative services and digital products including, but not limited to, graphic design, branding and brand identity development, marketing and promotional materials, motion graphics, website design and development, digital marketing consultations, and digital templates or downloadable design assets. Unless otherwise stated, all services and deliverables are provided digitally.

Payments and Billing
Full or partial payment may be required before services begin. By submitting payment, the client confirms that the payment information provided is accurate and authorized. All payments are considered final and non-refundable, and work will not begin until payment confirmation has been received. Graphics by Khai reserves the right to refuse, cancel, or decline any service request at its discretion. Failure to complete required payments may result in project delays, suspension, or cancellation.

No Refund Policy
Graphics by Khai maintains a strict no-refund policy. Due to the intangible, creative, and customized nature of digital services and products, all purchases are final. Once a payment has been processed, no refunds will be issued under any circumstances. This includes situations involving a change of mind, dissatisfaction after a project has started, failure to review service descriptions before purchase, or delays caused by client response time. Clients are strongly encouraged to ask questions and review all service details prior to making payment.

Revision Policy
To ensure fairness and professional service standards, Graphics by Khai provides up to three complimentary revisions for most design services. Revisions are intended to resolve minor design adjustments such as color changes, text edits, or layout refinements. Revisions do not include full redesigns, new project concepts, or changes to the original scope of work. Any revisions requested beyond the three included adjustments may be completed at an additional service fee determined by Graphics by Khai.

Client Responsibilities
Clients are responsible for providing clear project instructions, accurate information, and all required materials necessary for the completion of a project. Clients must also respond to communications within a reasonable timeframe to avoid delays. Graphics by Khai will not be held responsible for delays, design issues, or project outcomes caused by incomplete instructions, inaccurate information, or lack of communication from the client.

Intellectual Property
All preliminary design drafts, working concepts, and design files remain the intellectual property of Graphics by Khai until the project has been completed and all payment obligations have been fulfilled. Upon final approval and delivery, the client receives usage rights to the finalized design files as agreed. Graphics by Khai reserves the right to display completed projects in its portfolio, website, social media, and promotional materials for marketing and demonstration purposes.

Limitation of Liability
Graphics by Khai shall not be held liable for any direct, indirect, incidental, consequential, or financial damages resulting from the use of its services or digital products. This includes but is not limited to business losses, marketing performance outcomes, website functionality, third-party platform issues, or misuse of design files by the client. All services are provided without guarantees of specific financial, marketing, or business results.

Third-Party Services
Some services may involve third-party platforms, software, or hosting providers such as website platforms, social media networks, marketing tools, or external integrations. Graphics by Khai is not responsible for technical issues, outages, policy changes, or service interruptions caused by third-party providers.

Project Termination
Graphics by Khai reserves the right to terminate or refuse service if a client violates these Terms of Service, engages in abusive or inappropriate communication, initiates unauthorized payment disputes, or fails to cooperate during the project process. In such cases, all payments remain non-refundable.

Chargebacks and Payment Disputes
Initiating a chargeback or payment dispute after agreeing to these terms may result in immediate suspension or termination of services. Graphics by Khai reserves the right to provide evidence of services rendered to financial institutions during dispute investigations and may deny future services to clients who initiate fraudulent or unauthorized disputes.

Governing Law
Graphics by Khai operates internationally but is legally based in Jamaica, and all services and policies are governed by the laws of Jamaica. Any disputes, claims, or legal matters arising from the use of Graphics by Khai services shall be subject to the jurisdiction of Jamaican courts.

Policy Acknowledgment
By purchasing any service or product from Graphics by Khai (GK), you confirm that you have read, understood, and agreed to these Terms of Service, including the strict no-refund policy, revision policy, and limitation of liability provisions. Failure to read these terms does not exempt any client from compliance.
